Class Action vs. Precor Moves Forward

Gordon Gordon & Centracchio is moving forward in representing plaintiffs in a federal class action complaint against Precor, Inc., a maker of treadmills and other exercise equipment.

On June 16th in Chicago, Judge Harry D. Leinenweber denied a motion filed by Precor asking him to reconsider the complaint, writing that Precor had not supplied enough new information to warrant reconsideration. The complaint alleges that Precor sold treadmills it knew included inaccurate heart rate sensors.

Plaintiffs Gary Mednick and Steven Bayer are seeking warranty fraud claims in five states and alleging that Precor used deceptive marketing practices with nine specific treadmill models.
